U.S. Attorney: Distributing Genarlow Wilson tape violates law
Does anyone buy that a District Attorney David McDade should have released a video tape of minors having sex? And if D.A. McDade truly thought the girl was a victim or not was it not cruel of him to give the tape to the media? Who showed worse judgment an adult attorney releasing a tape of a minor having sex or Wilson the 17 year old who had consensual relationship with a minor? Also who should have a stiffer penalty?
AJC-Douglas County District Attorney David McDade violated federal law when he distributed a videotape from a rape and child molestation case to legislators and journalists, the U.S. Attorney in Atlanta said Wednesday.
U.S. Attorney David Nahmias said in a statement that federal law prohibits the distribution of the Genarlow Wilson videotape because it depicts minors engaged in sexually explicit conduct. He warned that people who had received it would be in violation of federal child pornography laws
Federal law prohibits the distribution, receipt and possession of child pornography in most circumstances, Nahmias said.
“These laws are intended to protect the children depicted in such images from the ongoing victimization of having their sexual activity viewed by others, potentially for years to come, particularly if the images are placed on the Internet or otherwise broadly enter the public domain,” Nahmias said.
“Accordingly, we have advised that the videotape at issue constitutes child pornography under federal law and should not be knowingly distributed, received, or possessed outside of law enforcement and judicial proceedings.”
McDade told the Associated Press that he was required to release the tape under the state’s Open Records Act because it was introduced as evidence at the trial.

I don’t think he should have given it out, however, if it is required under the open records law then he had no choice.

Federal laws overrule State laws. That is why the victim laws were put in place. And that is why he is in hot water! And as an attorney he has no excuses!
From what I have heard that once someone sees the tape, then they change their mind on their sorrow over the fate of Wilson. Wilson should have been charged on the other two rape charges that he committed, and we would not be here today. Wilson and his friends are pigs, and I have no sympathy for him!
All of the sympathizers would have a different opinion if it were a girl that they knew personally. This girl was drunk and possibly drugged up, and that is not consentual sex!

I did not see the tape but a jury did and did not see it your way.
If it were up to me, juvenile delinquents like Wilson would be sent to a seclude island to live out the rest of their lives with other low lifes. I am so sick of society making excuses for people that have no morals and the intellect of morons. The video is reality, as my husband says. If the sex were peachy keeno, then there would not be the outrage. The defense wants everyone to feel all of this sympathy for someone who has been raised to not respect young girls, and you know what people who grow up and act like Wilson then we can not expect them to change. You are what you are by the time you are eleven years old.
Well, show me the jury and then I’ll give you my analysis.
